Bhang’s legality in India is a complex, nuanced issue. While the overarching law, the Narcotic Drugs and Psychotropic Substances (NDPS) Act, criminalizes cannabis, it allows for exceptions for traditional preparations like bhang and for use in religious and medical contexts. 

However, the definition of “cannabis” in the 1961 Single Convention on Narcotic Drugs, which the Indian government supported, excluded bhang (made from leaves), creating a loophole that allows for its continued legality. Therefore, while not explicitly illegal nationwide, practices involving bhang are subject to strict regulation, often requiring government authorization for sales and potentially restricting recreational cultivation and consumption
